These terms govern the use of this promotional website and of the free email updates service relating to the video game It's Time to Evil. By using the site or subscribing to the updates you accept the following.
The processing of personal data is described in a separate document, the Privacy & Cookie Policy.
You agree not to:
The name It's Time to Evil, the logo, the characters, the illustrations, the texts, the videos, the music and all other content on this website are owned by Enrico Ascari or used under licence. Reproduction, distribution, modification or commercial use without written authorisation is prohibited.
You are free to share the link to this website and to quote its content for news reporting, review or commentary purposes, with attribution.
The Bangers and Fredoka typefaces are used under the SIL Open Font License 1.1.
The website may contain links to external resources. We have no control over such resources and are not responsible for their content or for their data protection practices.
The website and the updates service are provided "as is", without warranty of continuous availability, freedom from errors or fitness for a particular purpose.
To the maximum extent permitted by applicable law, the Owner shall not be liable for indirect, incidental or consequential damages arising from the use of, or inability to use, the website or the service, nor for any failure to deliver email communications for reasons not attributable to the Owner (spam filters, full mailbox, incorrect address, email provider malfunctions).
The mandatory rights granted to consumers by applicable law — including those under the Italian Consumer Code — remain unaffected in all cases, as does the Owner's liability for wilful misconduct or gross negligence, for personal injury, and in any other case where such limitation is not permitted by law.
Under Articles 33 et seq. of the Italian Consumer Code (Legislative Decree 206/2005), the limitation of liability clause contained in this Article 7 requires, in dealings with consumers, a specific and separate approval distinct from general acceptance of these terms. That approval is requested from you via a dedicated checkbox when you subscribe to the updates. In the absence of specific approval the clause has no effect as regards you, while the remaining provisions stay valid.
We may update these terms. The version in force is always published on this page, with the version number and effective date at the top. Changes apply from the moment of publication; if they concern the updates service, we will notify subscribers.
These terms are governed by Italian law. For users acting as consumers, exclusive jurisdiction lies with the court of the place of their residence or elected domicile, if located in Italy (Art. 66-bis of the Italian Consumer Code). Nothing in these terms deprives a consumer resident in another EU Member State of the protection of the mandatory provisions of the law of their country of residence. In all other cases the court of Modena, Italy, has jurisdiction.
Consumers resident in the European Union may also use the European Online Dispute Resolution (ODR) platform provided by the European Commission.
